Introduction
We welcome you to the REVISABLE AI website – https://www.revisable.in
and/or REVISABLE AI’s mobile app The Website and the App are owned and provided by Revio Education Private Limited, a company registered in Delhi, India
and incorporated under the Companies Act, 2013 (“REVISABLE AI”).
The Website and the Application or any other REVISABLE AI Software shall hereinafter be
collectively referred to as Revisable For the purposes of this ‘Terms and
Conditions’, accessing of the Platform together with any study material made
available or uploaded therein or downloaded, embedded therefrom shall hereinafter
be collectively be referred to as the Revisable Content
You are advised to read and understand these ‘Terms and Conditions’ carefully as
your use/access/browsing of the Platforms and any Service and/or registration
pertaining to subscription for the Platform, with or without payment for additional paid
Services (“Subscription”) through any means shall signify your acceptance of the
Terms and Conditions, and you to be legally bound by the same. These Terms
constitute an electronic record in line with the provisions of the Information
Technology Act, 2000 (as amended / re-enacted), the Information
Technology (Intermediaries guidelines) Rules, 2021 thereunder, as amended from
time to time and other relevant acts and rules.
If you do not understand the present Terms and Conditions or do not agree
with/accept any part thereof, you should immediately discontinue using or accessing
the Platform. Your continued use of the Platform and our Services, as the case may
be, amounts to express consent by you to the items set out in this Terms and
Conditions, including the REVISABLE AI Privacy Policy (https://www.revisable.in/pp
policy), Disclaimers, Terms of Use and any additional guidelines (collectively, the
“terms” or “terms of service”).
Eligibility
By agreeing to these Terms of Service, you represent that you are legally competent
to enter into an agreement and provide consent to these Terms of Service. You
further represent that you are of sound mind and are not prohibited from entering into
a legally binding contract, as per the applicable laws.
If you are a Minor in your country/state of residence, i.e. under the age of 18 years in
India or such age group which is considered a Minor in your country/state of
residence, you are not eligible to utilize or register for the Platform. If you wish to use
our Platform and Services, such use shall be made available to you by your legal
guardian or parents. The Parent or Legal Guardian agree to be bound by these
Terms of Service, in respect of the user’s use of the Platform and Service and we
shall assume that the user has obtained consent of the legal guardian or parent.
REVISABLE AI will not be responsible for any consequence that may arise, as a result of a
Minor’s usage or registering to the Platform and/or Services extended by REVISABLE AI.
If you are a school/educational institution or a corporate entity, you agree, as an
authorized representative of such entity, that the User is bound by the Terms of
Service, unless you or the entity has a separate written service agreement with
REVISABLE AI, that accepts these Terms of Service.
User Account / Registration
To use the Platform or avail our Services, it is compulsory to create an account. You
can become a registered user of the Platform by setting up a password-protected
account with REVISABLE AI, by entering the required details on our Sign-up page or you may login using the account details of any of our
partner websites. By setting up an account, you agree to accept any and all
responsibility for any and all activities that occur under your account, and agree to
the contents of our Terms of Service.
You must provide accurate, correct and complete information at the time of account
set-up and post account set-up. You are responsible for the security of your
passwords and for any use of your registered account. If you become aware of any
unauthorized use of your password or of your account, you agree to notify REVISABLE AI
immediately by sending an email to info@revisable.in. You agree that you are eligible to
create and use only one account and not to register/use an account with an identity
that is fraudulent or use the account of another User without the written permission
of the User.
REVISABLE AI reserves the right and sole discretion to refuse access to its Platform and
Services, terminate any account, remove or restrict any content, at any time, with or
without notice, in case we notice any illegal activity on or from account or if we have
reason to believe that any information provided by you is untrue, inaccurate,
outdated or incomplete or it is highlighted to us that the user is not abiding with the
Terms of Service set herein.
You can delete/unregister your account anytime by submitting a request to
info@revisable.in. REVISABLE AI may require additional information from the User, in order to
verify your identity before the deletion of your account.
User Content
The Users will have certain accessibilities to draft and share their own material
(“Content”) in the form of flashcards, short notes, questions, comments/answers to
queries on our Platform forum or any other Service made available on the Platform
and do hereby confirm that they own all copyright of the Content, or if you are not the
owner, that you have permission to use the content, and that you have all the rights
and permissions necessary or provide respective source link or citations as
demanded by the owner to permit uploading, displaying, publishing, sharing, storing,
hosting, reproduction, downloading, the transmission of such content.
The User further agrees that the Content does not contain material that is harmful to
children, defames or vilifies any person, people, races, religion or religious group,
misleads the addressee, if any, about the origin of the content or is false or
misleading in nature but may reasonably be perceived as a fact and the Content is
not obscene, pornographic, paedophilic, indecent, insulting or harassing including on
the basis of gender, threatening, harmful, invasive of privacy including bodily privacy
or publicity rights, abusive, inflammatory, published to mislead or harass any person
for financial gain or to cause any injury to any person, related to or encouraging
money laundering or gambling or otherwise objectionable or inconsistent with or
contrary to the laws in force or the Terms of Service.
By posting, submitting or transmitting User Content in the Platform other than
information submitted for registration you grant REVISABLE AI non-exclusive, royalty free,
transferable fully paid, license to copy, publicly perform, publicly display, reformat,
translate, excerpt (in whole or in part) and distribute User Content, in or through any
medium now known or hereafter invented, for any purpose. You acknowledge and
agree that neither REVISABLE AI nor any third-party service providers are responsible for
the Content of any material submitted, transmitted or posted by any User of the
Platform.
You agree that you will not upload on the Platform, any Content that is contrary to
the Terms of Service and other REVISABLE AI guidelines, as updated from time to time, or
that is contrary to applicable laws and regulations.
Use of User Information
We use the collected Information to analyze trends, conduct research, administer the
Platform, learn about each User learning patterns and movements around the
Platform and to gather demographic information and usage behaviour about our
userbase as a whole. Aggregated and individual, anonymized and non-anonymized
data may periodically be transmitted to external service providers, in order for us to
help improve the Platform. However, said third-parties do not have any
independence to share user information ahead. We will share your information with
third-parties only in the ways that are described in our Terms of Service.
We may disclose Information as and when required by law or any government
authority, enforced by any authority due to legal violations, in good faith where it is
necessary to protect our rights, protect user safety or the safety of others, investigate
fraud, address security or technical issues/breaches, with our trusted services
providers who work on our behalf and do not have an independent use of the
information, or with third-party service providers in order to personalize the Platform
or improve user experience.
The Platform does not sell or rent the user information to any third party. You hereby
acknowledge that when you use the Platform, we may collect certain information
from you like. Such collection of information shall be in accordance with our Terms of
Service and other policies as available on the Platform.
Security
Transactions on the Platform are secure and protected. Any information entered by
the User when transacting on the Platform is encrypted to protect the User against
unintentional disclosure to third-parties. The User’s financial information is not
received, stored by or retained by the Platform in any manner. This information is
supplied by the User directly to the relevant payment gateway, which is authorized to
handle the transactions and information provided, compliant with the regulations and
requirements of various financial institutions and payment franchisees, it is
associated with.
REVISABLE AI’s Content
You understand that any material, content and its arrangements that appear as
“REVISABLE AI Content” are owned by or licensed to REVISABLE AI, subject to copyright or
other Intellectual Property Rights held by third-parties. Accessing or using the
Platform does not give you ownership of any Intellectual Property Rights of REVISABLE AI.
The material posted in the Platform is made available to you solely for academic
purposes and for such other purpose as may be expressly permitted by REVISABLE AI.
REVISABLE AI grants you a limited sub-license or limited access (on a subscription basis)
to make personal use of the Platform, but not to download or modify it, or any portion
of it, except with express written consent of REVISABLE AI. Such limited access does not
permit any resale or commercial use of the Platform or its contents; any collection
and use of any material; any derivative use of the Platform or its contents; any
downloading or copying of information for the benefit of another merchant; or any
use of data mining, robots, or similar data gathering and extraction tools. Any portion
of the Platform may not be reproduced, duplicated, copied, sold, resold, visited, or
otherwise exploited for any commercial purpose without express written consent of
REVISABLE AI. You may not frame or utilize framing techniques to enclose any trademark,
logo, or other proprietary information (including images, text, page layout, or form) of
the Platform and/or its affiliates without the express written consent of REVISABLE AI.
You are not permitted to download, copy, photoshoot or circulate any part or portion
of the material offered on the Platform.
Advertisements and Promotions
The Platform may contain links to other websites/applications in the form of third-
party Advertisements. Said Advertisements are not under the control of REVISABLE AI and
we are not responsible for the contents of any such adverts.
You acknowledge and agree that REVISABLE AI is not responsible or liable for any loss or
damage of any kind incurred as a result of any dealings or as the result of the
presence of any non-REVISABLE AI advertisers on the Platform.
Adverts on the Platform, if any, should not be construed as an endorsement,
approval or recommendation by us of the owners or operators of those linked
websites, or of any information, graphics, materials, products or services referred to
or contained on those linked websites, unless and to the extent stipulated to the
contrary.
Payment
REVISABLE AI may determine subscription plans which shall allow access to the Platform
and usage of our Services. These subscription plans may be available on the
Platform from time to time. You are responsible for any taxes, including goods and
services tax, resulting from your use of the Platform. All fees are non-refundable. On
non-payment of subscription fees, REVISABLE AI reserves its right to terminate your
access to the Platform.
Refund, Cancellation & Pack Expiration Policy
As a general rule, all payments made on the Platform are final and you shall not be
entitled to a refund. REVISABLE AI reserves the sole right to cancel any subscriptions as
per our discretion in case the Platform is unable to deliver the Content and/or
Services in a satisfactory manner, due to technical issues, or the user tries to take
advantage of the system which violates our Terms of Service. REVISABLE AI will ensure
that any communication of cancellation of an order or any applicable refund will be
made within a reasonable period of time. For related requests the user shall drop a
mail at info@revisable.in.
Free Content
The User may be provided with certain material, without any prior payments or
subscription, upon registering to the Platform (“Free Content”). Such Free Content is
provided at the discretion of REVISABLE AI and can be modified into a paid subscription,
at any point of time after notifying to the respective users.
REVISABLE AI ‘Invite Program’
The REVISABLE AI Invite Program allows registered users to earn REVISABLE AI Points, when
the user creates an invite code and when a new person, they invite, signs up or
subscribes to a paid REVISABLE AI package. REVISABLE AI reserves the right to modify or
terminate this offer at any time without prior notice to users. REVISABLE AI further
reserves the right to deny a claim to the offer at its sole discretion or penalize the
user for misuse of the offer, and REVISABLE AI shall not be obliged to explain the same.
Modifications to Service
REVISABLE AI reserves the right to add, modify or delete any content or features available
on the Platform at any time, at its sole discretion.
Copyright
REVISABLE AI respects and recognize the intellectual property rights of others and
expects users of REVISABLE AI to do the same. REVISABLE AI reserves all intellectual property
rights in all text, programs, products, processes, technology, images, content and
other materials which has been uploaded on the Platform from REVISABLE AI’s end,
except for the ones mentioned in the ‘Take Down Policy’ of our Terms of Service.
Access to or use of the Platform does not confer and should not be considered as
conferring upon anyone, any license to REVISABLE AI or any third party’s intellectual
property rights. All rights, including copyright, in and to the Platform are owned by or
licensed to REVISABLE AI, unless mentioned otherwise with the permission of respective
owner. Any use of the Platform or its contents, including copying or storing it or them,
in whole or part, is prohibited without the permission of REVISABLE AI.
Take Down Policy
REVISABLE AI has posted various material on the Platform which are freely available on
multiple media platforms. We understand that such content has been uploaded on
said platforms by owners, with the motive of further dissemination. Source code of
such content has further been provided by the owners for third party use, including
REVISABLE AI. REVISABLE AI does not claim copyrights in the said material.
REVISABLE AI abides by the Copyright Act, 1957, read with the Copyright Rules, 2013 and
the Information Technology Act, 2000, and Rules framed thereunder and their
subsequent amendments. REVISABLE AI shall respond to written notifications of alleged
infringement by legitimate copyright owners by updating the source link or removing
or disabling access to alleged infringing material residing on the Platform.
To submit a copyright infringement notification, please write to the registered
address of REVISABLE AI, or send an email to info@revisable.in, along with supporting
documents to prove your ownership.
Restrictions
The Platform is made available for personal, non-commercial use only, unless REVISABLE
AI has a separate service agreement with the party/entity in question. The User is
prohibited from using the Platform for any illegal or unauthorized purpose.
The User agrees to not indulge in:
1. Modifying, adapting, translating, or reverse engineering any portion of the
Platform, for commercial use, without prior written permission of REVISABLE AI
2. Removing any copyright, trademark or other proprietary rights notices contained
in or on the Platforms content
3. Collecting any information about other users for unauthorized purposes
4. Creating or transmitting unwanted electronic communications such as spam or
chain letters to other user or interfering with other user's enjoyment of the service
5. Submitting information or material of any third party without such third party,
prior written consent or without providing source links for the same
6. Defeat, damage or interfere with any security feature of the Platform, nor
attempt to do so
7. Use or attempt to use any engine, software, tool, agent, or other device or
mechanism (including, without limitation, browsers, spiders, robots, avatars, or
intelligent agents) to navigate or search the Platform, other than features and/or
search agents made available on the Platform
8. Deceive or mislead, the addressee or REVISABLE AI, about the origin of a message or
request or knowingly and intentionally communicate any information which is
patently false or misleading in nature, but may reasonably be made perceived as a
fact
9. Impersonate another person
10. Any other conduct, act or behaviour that is illegal or unlawful.
Termination
REVISABLE AI may, in its sole discretion, immediately terminate, limit or suspend your
account, delete your registration, other information, or User Content, and/or prohibit
you from using or accessing the Platform without any notice, if you have violated any
of the provisions in our Terms of Service.
The user may terminate their account on their device, by removing the application
from said device and following the instructions on the application or through the
Platform. On termination, you lose the right to access or use the Platform.
Consent for receipt of Phone Calls, SMSs and/or E-mails
Your registration on the Platform shall be deemed to be your consent to be
contacted by REVISABLE AI on the mobile number shared by you, by way of SMS or email
notifications or messages in any other electronic form, any social media network
linked by you to your account, WhatsApp, Telegram and any other such messaging
modes. You agree and acknowledge that at no times shall REVISABLE AI be liable for
contacting you through any of the mediums stated above.
Limitation of Liability and Indemnification
You agree to indemnify, defend and hold harmless, REVISABLE AI including but not limited
to its affiliate vendors, agents and employees, from and against any and all losses,
liabilities, claims, damages, demands, costs and expenses (including legal fees and
disbursements in connection therewith and interest chargeable thereon) asserted
against or incurred by us that arise out of, result from, or may be payable by virtue
of, any breach or non-performance of any representation, warranty, covenant or
agreement made or obligation to be performed by you, pursuant to our Terms of
Service. Further, you agree to hold REVISABLE AI harmless against any claims made by
any third-party due to, or arising out of, or in connection with, your use of the
Platform, any claim that your material caused damage to a third-party, your violation
of our Terms of Service, or your violation of any rights of another, including any
intellectual property rights.
In no event shall REVISABLE AI, its officers, directors, employees, partners or suppliers be
liable to you, the vendor or any third-party for any special, incidental, indirect,
consequential or punitive damages whatsoever, including those resulting from loss of
use, data or profits, whether or not foreseeable or whether or not we have been
advised of the possibility of such damages, or based on any theory of liability,
including breach of contract or warranty, negligence or other tortious action, or any
other claim arising out of or in connection with your use of or access to the Platform.
The limitations and exclusions in this section apply to the maximum extent permitted
by applicable law.
Grievance Redressal (+Notice)
If you have any questions about our Terms of Service, the practices of REVISABLE AI, or
your experience with the Platform or our Services, you can e-mail us at
info@revisable.in. Further, if you believe that any piece of content, material or
information accessible on the Platform violates our Terms of Service and/or any
applicable laws, please notify us on info@revisable.in.
Each complaint or query must specify and/or be accompanied with the relevant
information/documents such as your contact details wherein your full name, address,
telephone number and email address are provided, so that we may contact you in
case of any clarifications, or, in case any counter-request is received by the person
who has uploaded the content, material or information in question, along with
supporting documentation for the complaint or query, if applicable.
Liability and Warranty Disclaimer
The User hereby expressly understands and agrees that:
1. REVISABLE AI AND ITS AFFILIATES MAKES NO REPRESENTATIONS ABOUT
THE COMPATIBILITY, SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS
AND ACCURACY OF THE INFORMATION, MATERIAL, SOFTWARE AND REVISABLE AI
SERVICES CONTAINED ON THE PLATFORM FOR ANY PURPOSE. ALL SUCH
INFORMATION, MATERIAL, SOFTWARE AND REVISABLE AI SERVICES ARE
PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. REVISABLE AI AND/OR ITS
RESPECTIVE SUPPLIERS HEREBY DISCLAIMS ALL WARRANTIES AND
CONDITIONS WITH REGARD TO THIS INFORMATION, MATREIAL, SOFTWARE,
AND REVISABLE AI SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND
CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, TITLE AND NON-INFRINGEMENT.
2. YOU SPECIFICALLY AGREE THAT REVISABLE AI SHALL NOT BE RESPONSIBLE
FOR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR
TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR
NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO
THROUGH THE PLATFORM.
3. YOU SPECIFICALLY AGREE THAT REVISABLE AI IS NOT RESPONSIBLE OR
LIABLE FOR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING
INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT REVISABLE
AI IS NOT RESPONSIBLE FOR ANY SERVICES SENT USING AND/OR
INCLUDED IN THE PLATFORM BY ANY THIRD-PARTY.
4. REVISABLE AI DOES NOT GUARANTEE COMPATIBILITY WITH ALL OPERATING
SYSTEMS, SMART PHONES, NETWORKS, INCLUDING ALL VERSIONS OF
THEM. THE USE OF THE SMART PHONE, SITE, AND SOFTWARE, AND
AUTOMATIC UPGRADES OF THE SOFTWARE, MAY REQUIRE UPGRADES TO
COMPUTER OR SMART PHONE OPERATING SYSTEMS, NETWORKS, AND
APPLICATION SOFTWARE.
5. ANY REQUIREMENTS FOR THE FUNCTIONING OF THE PLATFORM ON
YOUR PHONE OR DEVICE, SUCH AS SUFFICIENT BATTERY BACK UP,
INTERNET NETWORK STRENGTH ETC. IS YOUR SOLE RESPONSIBILITY.
6. IN NO EVENT SHALL REVISABLE AI AND ITS AFFILIATES BE LIABLE FOR ANY
DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL
DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT
LIMITATION, DAMAGES FOR OR IN RELATION TO THE PROVISION OF OR
FAILURE TO PROVIDE REVISABLE AI SERVICES, OR FOR ANY INFORMATION,
SOFTWARE AND REVISABLE AI SERVICES OBTAINED THROUGH THE PLATFORM,
OR OTHERWISE ARISING OUT OF THE USE OF, WHETHER BASED ON
CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF
REVISABLE AI OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE
POSSIBILITY OF DAMAGES.
7. YOU EXPRESSLY AGREE AND UNDERSTAND THAT THE CONTENT
AVAILABLE IN THE PLATFORM IS FOR EDUCATIONAL INFORMATION
PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR YOUR ACADEMIC
CURRICULUM. REVISABLE AI AND ITS AFFILIATES, SUBSIDIARIES, DIRECTORS,
AGENTS AND EMPLOYEES, AND THIRD PARTIES ASSOCIATED WITH THE
PLATFORM MAKE NO WARRANTY OF ANY KIND CONCERNING THE CONTENT
OR ANY OUTCOME AND/OR THE RESULTS OF THE ENTRANCE EXAMS OR
ANY OTHER EXAM TAKEN BY YOU INCLUDING BUT NOT LIMITED TO THE
FLASHCARDS, MOCK TESTS, QUESTIONS, PRODUCTS AND ANY OTHER
INFORMATION PROVIDED ON THE PLATFORM. WHILE EVERY EFFORT IS
MADE IN PREPARATION OF EDUCATIONAL MATERIAL INTENDED FOR ITS
USERS, REVISABLE AI AND ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, AGENTS
AND EMPLOYEES ARE NOT RESPONSIBLE FOR ANY ERRORS, OMISSIONS
OR STATEMENTS ON THE PLATFORM OR ANY WEBSITE WITH WHICH THESE
PAGES CONNECT WITH.
Miscellaneous
1. Waiver: The failure of REVISABLE AI to act with respect to a breach of our Terms of
Service, by you or others, does not constitute a waiver and will not limit REVISABLE AI’s
rights with respect to such breach or any subsequent breaches.
2. Severability: If any provision of our Terms of Service is held to be
unenforceable, such provision will be reformed, only to the extent necessary, to
make it enforceable.
3. Force Majeure: REVISABLE AI shall be under no liability whatsoever in the event of
non-availability of any portion of the Platform or subscribed content occasioned by
act of God, war, disease, revolution, riot, civil commotion, strike, lockout, pandemic,
epidemic, lockdown, flood, fire, failure of any public utility, manmade disaster,
infrastructure failure, or any other cause whatsoever beyond the control of REVISABLE AI.
4. Jurisdiction: These Terms of Service will be governed by and construed in
accordance with the laws of India, and any dispute arising out of the use of the site
shall be subject to the exclusive jurisdiction of courts at New Delhi, India. If, for any
reason, a court of competent jurisdiction finds any provision or portion of our Terms
of Service to be unenforceable, the remainder of the Terms of Service will continue
in full force and effect. The user shall not assign these Terms of Service or assign
any rights or delegate any obligations hereunder, in whole or in part, whether
voluntarily or by operation of law, without our prior written consent, any such
purported assignment or delegation will be null and void and of no force or effect.
5. Entire Agreement: These Terms of Service, and any other policy cited in said
Terms of Service on the Platform, constitute the entire agreement between you and
REVISABLE AI and govern your use of the Platform, superseding any prior agreements
between you and REVISABLE AI.
